Data Fiduciary: Oakkart (“CloutROI”, “we”, “us”), Mumbai, Maharashtra, India. This policy should be read with our Terms of Service.
1. Data We Collect
- Account data: name, email, phone, password (hashed), role (Brand, Creator, etc.), and profile information you provide.
- Identity and payout data (Creators): information required to verify identity and enable payouts — such as PAN, identity documents, and bank/payout account details. Identity verification and bank verification are performed through our payment partner (Razorpay).
- Business and tax data (Brands): company details, GSTIN, billing information.
- Payment data: transaction records and payout records. Card and bank credentials are processed by our payment partner; we do not store raw card data.
- Social verification data: information you provide or authorise to verify your social accounts and audience.
- Content and communications: Deal deliverables, messages between users on the Platform, reviews, and dispute records.
- Usage and technical data: device, log, and usage information, and cookies (see Section 8).
2. Why We Use Your Data (Purposes)
- to create and operate your account and provide the Platform;
- to facilitate Deals, escrow, payouts, refunds, and invoicing;
- to verify identity and complete KYC for payouts, as required by our payment partner and applicable law;
- to deduct and report tax (GST, TDS) as required by law;
- to detect and prevent fraud, off-platform circumvention, and abuse;
- to provide support, resolve disputes, and conduct moderation;
- to send service communications and, where permitted, updates; and
- to comply with legal and regulatory obligations.
3. Legal Basis / Consent
We process your data based on your consent, the performance of our contract with you (the Terms of Service), our legitimate uses as permitted under the DPDP Act, and compliance with law. Where we rely on consent, you may withdraw it (see Section 7); withdrawal may limit your ability to use parts of the Platform.
5. Data Storage and Localisation
Transaction and payment-related data are stored on servers located in India, consistent with Reserve Bank of India requirements applicable to our payment partner. We apply reasonable technical and organisational security measures to protect your data.
6. Data Retention
We retain personal data for as long as your account is active and as required to provide the Platform, and thereafter as required by law (for example, tax, accounting, and KYC record-keeping obligations) or to resolve disputes and enforce agreements. When no longer required, data is deleted or anonymised.
7. Your Rights
Subject to the DPDP Act and other applicable law, you may:
- access the personal data we hold about you;
- request correction or completion of inaccurate or incomplete data;
- request erasure of your data where it is no longer required;
- withdraw consent for processing based on consent;
- nominate another person to exercise your rights in the event of death or incapacity; and
- raise a grievance with our Grievance Officer (Section 9).

9. Grievance Officer
In accordance with the DPDP Act and applicable IT rules, our Grievance Officer can be reached at support@cloutroi.com. We will acknowledge and address grievances within the timelines required by law.
10. Children
The Platform is intended for users aged 18 and over. We do not knowingly collect data from children.
11. Changes to This Policy
We may update this policy. Material changes will be notified through the Platform. The “Last updated” date above reflects the latest version.
